                   	     ORDINANCE NO. 10217
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHEAST FROM HAMILTON AVENUE,
                   SOUTHWEST OF NOLL STREET,  MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located southeast from Hamilton Avenue,
         southwest of Noll Street, more particularly described herein, 
and
         as shown on plat attached hereto and made a part hereof by 
refer-
         ence:
                A 10 foot wide unopened alleyway beginning on the
                southeast line of Hamilton Avenue 211.5 feet
                southwest of the intersection of the southeast line
                of Hamilton Avenue with the southwest line of Noll
                Street, and extending southeast some 402.55 feet
                between parallel lines to the northwest line of
                Woodland Avenue.  Said alleyway separates lots 5,
                9, and 14, block C, Frazier and Colville's Addition
                to Hill City, as shown by plat of record in plat
                book 4, page 28, ROHC, from lots A and D, Fletcher
                Tract, not recorded, and lot 15, said Frazier and
                Colville's Addition.  Tax Map No. 135D-P-2, 7, 8,
                9, 28, and 29.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:

                1. Resubdivision to combine parcels 8 and 28.	  
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	  
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
